Complaint:
Background. IAW with Florida State Law, paragraph 720.307-Transition of association control in a community, a developer must provide to the Home Owner Association (HOA) board, among other things, the financial records of the association from the date of incorporation through the date of turnover.
Issue. The financial records of the association as well as other pertinent documentation have not been provided to the Vizcaya at Waterford Board of Directors (BOD). The BOD, in conjunction with our Property Management Company, Presidential Group South, Inc. has been unsuccessful in reconciling the financial records and hence our financial status cannot be determined. A certified letter was sent to the developer, Café Homes, Inc., on February 2, 2005 detailing the exact records we are lacking and questioning an apparent deficit in funding through December 31, 2004 in the amount of $4962.62. Café Homes has not provided the materials required by Florida state law and has been otherwise uncooperative in providing the required documents and funding. The BOD has reviewed numerous HUD closing statements where residents have been incorrectly charged HOA dues at time of closing. In addition, the BOD believes that during the first year of HOA dues collection by Café Homes, the HOA was incorrectly billed for the construction of the sign of the development rather than properly being part of developer’s cost. The lack of cooperation from Café Homes along with the suspected financial discrepancies causes the HOA to wonder if there are not even more significant problems with the financial accounting to date. Without accurate financial statements and other requested documentation, the BOD is being forced to obtain the assistance of the BBB and the Florida Real Estate Commission. Our community has been forced to suspend some maintenance agreements due to apparent lack of funding. Your assistance is requested to complete a smooth and successful transition between the developer and the community
